Judge throws out $5M verdict, grants NCAA request for new trial

BIRMINGHAM, Ala. -- A judge threw out the $5 million verdict an Alabama football fan won in his lawsuit accusing the NCAA of slander,
ruling in a decision made public Wednesday that jurors were swayed by prejudice.

Circuit Judge William Gordon granted the NCAA's request for a new trial in a lawsuit filed by timber dealer Ray Keller. He...

Hiring PI's is not that unusual. Especially in civil cases, where jury tampering might have been suspected. You have to agree, if UA boosters were willing
to shell out the money they did for players, it wouldn't be out of the realm of possibility that they might try to influence the jury in some way, even if
it is just 1 juror, or a family member of a juror. Not to say that happened, and it wasn't mentioned in the appeal, but given the size of the verdict, if
it were me, I'd...

Although I do not know the extend to what should and shouldn't be allowed in the court, I will says in regards to what was allowed, I believe the
verdict was correct. But without that evidence and testimony, I am sure the verdict would have been much different, but I still ponder as to why the NCCA hired
the Private Investigators to seek out the jurors if they knew the case was handled improperly, but then again it could be to prove the verdict was rewarded
because of this mistake....

The judge improperly allowed the jury to consider evidence presented as damages, which as a matter of law, were not proved and shouldn't have been allowed
as evidence. He also allowed the jury to consider testimony by a witness, or witnesses, which shouldn't have been allowed. Without these things, it is fair
to assume that the case would have been thrown out of any court in the country, outside of Alabama. Now proving damages to the average person is one thing, but

Good post theplainstruth, I did not know the details as to why they appealed the ruling other than the article . But according to my mother, they were
presented proof without an reasonable doubt ( in their opinion ) (which is good enough to sentence death in some states) that finical damages did occur and the
amount of the 5 million settlement was not a figure out of the air but based on evidence presented. The question of how someone enterpretents the actions of
the NCAA to be direct or...

The burden of proof here is tremendously high, and the NCAA has a great deal of latitude in policing their own organization. I read the appeals in this case,
and the judge ruled the only way he could. That doesn't mean the jury was tampered with, or wanted to act on behalf of either Bama, or Keller. Given the
case law on this, the jury was wrong, and the verdict should have been set aside as a matter of law. The jurors could have done what they thought was right,

As much as I hate to say this, and having inside information on the case (my mother was on the jury), there is a lot more to this story than in print. For
example: no Facts or hard evidence from the NCAA....... There were Auburn fans (like my mother) on the jury and she sure as hell didn't get paid
off...haha.....but seriously.....I know Keller and do not think highly of him (the clean version), but the ruling was legitimate. The NCAA carries a big check
book.... and I knew this would...

The NCAA nailed everyone, fairly, and squarely. Bama would be better off if these people would just give it up. By suing, it just keeps old news on the front
page. There was absolutely no merit to Keller's case, or any of the multitude of other suits that have been filed. They keep embarassing UA with this
garbage, at least as far as national opinion goes.
